GENERAL PROVISIONS Welcome to LIFT session an online platform and application (the “Website”) owned and operated by LIFT Digital Inc. (“we”, “us” or “our”) that provides its users personal training through online sessions (the “LIFT Service”). The purpose of this Privacy Policy is to describe how we collect, use and disclose the personal information you provide us or that we otherwise collect from you when you use the LIFT Service and how it can be accessed by you and deleted when necessary. This Privacy Policy also explains what non-personal information we collect from you when you are using the LIFT Service. By using the LIFT Service, you expressly consent to the information handling practices described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use the LIFT Service.

PERSONAL INFORMATION THAT WE COLLECT Here is personal information about you that we may collect: When you register, we will collect your full name, company, email address and we will ask you to choose a password. We will also ask you to provide us with your objectives/goals and your time availability for your initial free session; We will ask for your email address and password when you login; Before your LIFT session, we will also ask you to fill out a health questionnaire and to provide us with a profile picture, your phone number as well as your height, weight, date of birth, timezone and emergency contact and phone number; We also collect the following information associated with your account: your fitness level and other specific (injury history, gender, preferences), session summary emails, the name and number of your exercise programs, your LIFT session statistics and history, including the number of sessions you have done per month and in total, details such as per exercise performance, heart rate profile (if a monitor was used), calories burned, difficulty level, coach’s notes, etc.; Your payment information when you select a LIFT session subscription plan (e.g. LIFT Basic, LIFT Select, LIFT Premium); Any information provided during the course of your interactions with us or with the LIFT coaches (i.e., content of emails, web chat. “Contact Us” form, etc.).

NON-PERSONAL INFORMATION THAT WE COLLECT We also collect the following non-personal information when you use the LIFT Service: We collect information on the software that you use to access the LIFT Service. This information may include such elements as your IP address, web browser and the device that you use (i.e., type, version, name, push notifications status, etc.), the webpage that linked you to our site and the identifiers associated with your devices. We use “cookies” to collect information and to operate and improve the LIFT Service. The cookies are simple text files that we store on your device. We may use cookies to record your email and password for when you log on to the LIFT Service in the future. We may also use cookies to activate certain features of the LIFT Service, to better understand and improve your interaction with the LIFT Service and to compile aggregate data about the traffic generated by the LIFT Service (length of visits, average duration of each visit, viewed pages, etc.). Most web browsers allow you to configure your options so as to refuse cookies or ask for your consent before cookies are accepted from the websites that you visit. However, some parts of the Website will not work properly if your browser does not accept cookies. Consequently, if you do not accept cookies, you might not be able to use all of the LIFT Service’s features.

USE OF YOUR PERSONAL INFORMATION We may use your personal information in the following ways: To create and manage your account and provide you with the LIFT Service; To identify you when you log in and during a LIFT session; To calculate caloric burn and heart rate performance when a heart rate monitor is used; To develop, improve and optimize the contents and features of the LIFT Service; To assist you with general information and customer and technical support; To process and follow-up on any question, comment, suggestion, concern, request, complaint or feedback; To assess your preferences and degree of satisfaction with the LIFT Service; To personalize your experience and to allow us to deliver the type and content of product offerings in which you are most interested; To inform you about the LIFT Service and to follow-up on our promotions or contests, to the extent permitted by applicable law; For any other purpose authorized or required by applicable law.

DISCLOSURE OF YOUR PERSONAL INFORMATION Your personal information will not be disclosed to third parties, except in the following cases: We may share your personal information with our service providers or partners who are assisting us, in association with the performance of their services or to the extent necessary for the carrying out of their mandate (for example, if you have booked your LIFT session through one of our fitness club partners, etc.). We may also disclose your personal information in connection with, or during negotiations of, a prospective or a completed business transaction relating to any reorganization, merger, loan, purchase, sale or other acquisition of all or a portion of our assets or activities by or into another corporation, including in the context of a due diligence or closing process. In all cases where such disclosure is permitted or required by applicable law (for example, situation that threatens the life, health or safety of an individual, court order, etc.).

SOCIAL MEDIA SHARING Some features offer you the possibility to share content on social media such as Facebook, Instagram and Twitter (for example, your results after completing a LIFT session or pictures of you taken while you were training). All social media sharing is based on permissions provided by you. Trainers can only share content if you have allowed it through the application. By default, the permission setting is off. Please remember that the use these third parties make of your information will be governed by their privacy policies and that anyone can read, collect and use information that you publish in a public forum or on social media.

YOUR OPTIONS We offer you a number of options. Here are a few: You can change your password at anytime; You can edit your personal information at any time. This is the best way to ensure that your personal information is accurate and up to date; You can access your profile and view the information contained therein, such as your session history, statistics, etc.; You can log out of the Website securely by clicking on the “Log Out” button in the upper right-hand corner of your screen; You can leave the session after the session review by pressing the door in the top right corner and then press leave or by pressing the door and choosing discard if you are in session.

THIRD-PARTY WEBSITES Our Website contains links to other websites which are owned and operated by third parties, whether these be partners, suppliers or social media (like Facebook, Twitter, You Tube and Instagram). These links will let you leave the Website. We have no control over the operation of these sites and the use that you make of them, and we are not responsible for any of their procedures and practices. We therefore encourage you to review and understand the privacy policies published on any third-party websites you may access through the LIFT Service before using or submitting any information to them. We accept no responsibility or liability in respect of these third-party services.

FRIEND REFERRALS We may suggest you to invite your friends to a free LIFT session to save on future sessions. In such cases, it is your responsibility to ensure that these individuals are people with whom you have a personal relationship (frequent communications, shared affinities, opinions, etc.). We ask you to only invite people who are part of your close circle and who are likely to be interested in the LIFT Service.

DETENTION AND RETENTION OF YOUR INFORMATION Your personal information is stored on servers hosted in the United States. Your personal information is subject to the laws of the countries in which it is stored and used. The applicable foreign laws and privacy legislation of such country may differ from those applicable in Canada, and may be subject to disclosure to the governments, courts or law enforcement or regulatory agencies in that foreign jurisdiction, pursuant to applicable laws in that foreign jurisdiction. By providing us with your personal information, you agree to allow it to be transferred to the United States. Your personal information is stored for as long as we need it in order to provide the LIFT Service to you.

CHILDREN The LIFT Service is directed to people who are at least 18 years old. If we learn that we have collected personal information on a person under 18 years of age without first having received the authorization of a parent or guardian, we will take the necessary measures to delete that information within a reasonable timeframe.

SECURITY We have implemented several security measures to help protect your personal information (for example, regular scanning of the Website in order to assess vulnerabilities, sensitive information encrypted via Secure Socket Layer (SSL) technology, etc.). However, please note that no computer system is perfectly secure and our security measures can only serve to help minimize the risk of security issues.

RIGHT TO ACCESS AND CORRECT On written request and subject to proof of identity, you may access the personal information that we have collected, used or disclosed and request that it be corrected, as authorized or required by applicable law.

UPDATE The Privacy Policy may be periodically amended to reflect changes made to our practices.
